My neighbour wants to erect a fence, do we HAVE to pay for half of the cost?
After we warned them them their aggressive dogs were wandering all over our lawn, sh!tting on it and harassing us and our holiday renters, they decided they wanted a fence, as only a fence would prevent their dogs from doing those things (obviously never heard of a leash or anything…).
They said we should pay for half.
Do we have to? We have lived here for over 10 years, and they only just moved in. And it’s because of their dogs a fence is even needed anyway! Why should we have to pay?
By the way this is NSW Australia.
In NSW yes you have to pay half of any boundary fence.
If your neighbour wants a bigger fancier fence than a timber one, you pay half the cost of the timber fence and the neighbor is responsible for the rest, but boundary fences are joint responsibility
